pursue legal action against her. The statement of charges was
based upon the same conduct that was the subject of the 2009
investigation.
The court concluded that the 2009 charges were properly
substantiated. In its fact finding, the court stated that the
defendant “had a pattern of engaging in sexual intercourse with
... a minor, that the... minor was only fourteen years
old at the time of the intercourse, that the defendant was
charged in 2009 with the same conduct, that the defendant did
not confess to committing the same offenses... and that the
defendant falsely told the police that the minor never told him
that she was only fourteen years old.” The court concluded
